Procedura contenciosului administrativ și Noul Cod de Procedură Civilă

Abstract

The New Civil procedure code will enter into force next year and it will bring the Romanian legislator the new vision on how to develop a trial. The administrative procedure will also be partially changed by the code, because Law no. 554/2004 does not regulate complete provisions, so that the Civil procedure code applies. In order to identify the possible evolution of the jurisprudence following the enforcement of the New Code it is important to determine the new provisions regarding: the possibility of the judge to extend the field of the subjects before the court, the complaint, the communication of documents in the procedure, the possibility to lodge an appeal against the first instance judgment, the enforcement of the court decisions.
