Credibilitatea reformelor anticorupție. Considerații asupra deciziei Curții Constituționale privind nepublicarea declarațiilor de avere și nedeclararea averii familiei
Abstract
Systemic corruption remains a persistent problem in Romania, taking on new dimensions in the current regional context. Attempts to dismantle the legal framework for integrity and undermine the independence of the National Integrity Agency (ANI) are hallmarks of political interference in the fight against corruption. The new Decision no. 297 of 2025 by the Constitutional Court, a veritable “jurisprudential revival”, reignites the discussion on public integrity, transparency, the rule of law, and good governance, bringing it beyond the realm of serious legal controversy. However, by distorting ECJ and ECHR case law and disregarding Romania’s commitment to EU fundamental values, this decision deemed the provisions for publishing asset and interest declarations, as well as family asset declarations, unconstitutional.
